This Maryland General Assembly session has already produced an effort to keep the carryout cocktails flowing. Now the state’s alcohol manufacturers are seeking permission to further ease the convenience for stay-at-home imbibers by, among other things, shipping craft brews straight to a customer’s house.

New legislation backed by the Brewers Association of Maryland, Maryland Wineries Association and Maryland Distillers Guild would allow local alcoholic beverage manufacturers to ship booze directly to consumers upon request. The bill would also make the temporary to-go and delivery sales that breweries and distilleries have enjoyed during the pandemic into a permanent feature.
The proposal, House Bill 1232, seeks to create some stability for an industry that has been buffeted by the Covid-19 pandemic over the course of the past year, said Brad Rifkin, a lobbyist for the manufacturers. An emergency executive order issued by Gov. Larry Hogan in the pandemic’s early days allowing take-out and delivery alcohol sales has been a saving grace for breweries, wineries and distilleries throughout taproom and tasting room closures, shifting capacity limits and other pandemic-related hurdles.
COVID-19 Updates Impacting Maryland Wineries
On Tuesday, November 10, 2020, Governor Hogan introduced a new Executive Order updating the guidelines for the COVID-19 response. This order reduces restaurant/bar capacity to 50%. Masks are still required indoors and when social distancing is not possible.
Baltimore City and Montgomery County each introduced local orders regarding COVID-19. Each order includes guidelines specific to their jurisdictions.
Baltimore City: Reduces restaurant/bar capacity to 25% and closes all “bars” that do not offer food for indoor service.
Montgomery County: Reduces restaurant/bar capacity to 25% and mandates that service ends at 10:00 pm.

UPDATE | November 13, 2020
On Thursday, November 12, 2020, the governments of Anne Arundel County and Frederick County issued executive orders and guidance specific to their jurisdictions.
Anne Arundel County: Indoor capacity to 25%, outdoor to 75% of indoor capacity, alcohol sales end at 10:00 pm.
Frederick County: 25% capacity or 25 people, whichever is less—both indoor and outdoor. This goes into effect at 5:00 pm on Friday, November 13 and applies to bars; nightclubs; breweries; distilleries; wine tasting rooms; event venues including but not limited to civic service clubs, private clubs, indoor agro-tourism enterprise activities; fairgrounds; farm-based alcoholic beverage tasting rooms; farm brewery tasting rooms; rodeos; auction houses; and social and private gatherings. Applies to weddings as of November 30.
